1. These Terms
1.1 These Terms of Service ("Terms") are a contract between you and Chatlytics. They govern your access to and use of Chatlytics Blogs, the service that captures the messages of a WhatsApp group or channel you connect and publishes them as a blog on a subdomain of chatlytics.blog (the "Service").
1.2 You accept these Terms by opening an account, connecting a group, or starting a paid plan. If you do not accept them, do not use the Service.
1.3 "You" means the person or entity that holds the account and connects the group (the "Customer"). If you connect a group for an organisation, you confirm that you are authorised to bind that organisation to these Terms.
1.4 These Terms apply together with our Privacy Policy, Refund and Cancellation Policy, and Accessibility Statement, which are published alongside them. The Refund and Cancellation Policy forms part of these Terms.
1.5 Where the Customer is a consumer in Israel, the Israeli Consumer Protection Law, 5741-1981 (the "Consumer Protection Law") applies. Nothing in these Terms excludes or limits a right that the law does not allow us to exclude or limit. Where these Terms conflict with a mandatory consumer right, the mandatory right prevails.
2. Definitions
2.1 Blog — the public website we generate for a connected group, published at a subdomain of chatlytics.blog.
2.2 Group — the WhatsApp group or channel that you connect to the Service.
2.3 Capture Number — the telephone number we publish for connecting a Group, which you add to the Group or whose join request you approve.
2.4 Content — text, images, video, audio, links, reactions, polls and any other material captured from a Group or uploaded by you.
2.5 Your Content — Content from the Groups you connect, together with any material you upload or configure in the Service.
2.6 Plan — the subscription tier you purchase, as described in section 8.
2.7 Subscription Period — the monthly or annual period for which you have paid.
2.8 Merchant of Record — the entity that processes payment, issues the receipt and handles applicable taxes on our behalf, currently Polar.sh.
3. The Service
3.1 You connect a Group by adding our Capture Number to it, or by approving our join request. From that point we capture the Group's messages and publish them as blog posts, in the structure and design we generate for that Blog.
3.2 Blogs are public by default. Password protection is available as an option on the Plans where it is offered. A public Blog can be read by anyone with its address and may be indexed by search engines.
3.3 You decide whether to publish. The Service gives you controls to pause and resume publication, to backfill recent history where the platform makes it available, to delete the Blog, and to request an export of your data.
3.4 Group members are represented on the Blog by the public WhatsApp push name they use in the Group. We do not add real names, profile photos or telephone numbers to posts.
3.5 The Service depends on access to WhatsApp that you authorise. We do not bypass access controls, scrape Groups you have not connected, or access Groups you have not authorised.
3.6 Chatlytics is not affiliated with, endorsed by, or sponsored by WhatsApp, Meta Platforms, Inc., or Google LLC. WhatsApp, Meta and Google are the trademarks of their respective owners.
3.7 We may change, improve or retire features of the Service. If a change materially reduces what you paid for during a Subscription Period, we will give you reasonable notice and, where appropriate, a refund under our Refund and Cancellation Policy.
4. Accounts and eligibility
4.1 You must be at least 18 years old and legally capable of entering into a contract, or a properly registered business or organisation.
4.2 You must provide accurate account details, keep your login credentials secure, and tell us promptly if you suspect unauthorised access. You are responsible for activity carried out through your account, including by people you authorise.
4.3 A Plan includes a fixed number of Blogs. You may not use one Plan to operate more Blogs than it includes, or share an account between unrelated organisations.
5. Connecting a Group — your responsibilities
5.1 You may connect a Group only if you are its owner or administrator, or if you have the owner's or administrator's permission to do so.
5.2 You confirm that you have every permission and legal basis needed for the messages in the Group to be captured and published as a public Blog. This includes permissions required under privacy and data protection law and under the rules of the Group itself.
5.3 You are responsible for ensuring that Group members are aware that the Group's content is published publicly, and for giving any notice or obtaining any consent that the law or the Group's rules require. Where a Group includes minors or sensitive personal information, that responsibility is yours.
5.4 You may not connect a Group that you do not control, use the Service to monitor or surveil individuals, or connect a Group in order to expose its members to harm.
5.5 If a Group member objects to the publication of their messages or name, you will handle the request as the operator of the Blog. We will also act on valid legal requests and may remove content ourselves under section 6.5.
6. Content, ownership and licence
6.1 You own Your Content. We claim no ownership of it, and publishing it through the Service does not transfer ownership to us.
6.2 You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, index, publish, display, distribute and back up Your Content, and to make the technical copies needed to operate and support the Service. This licence lasts for as long as the content is published through the Service and for the retention period described in section 12, is limited to what is needed to run the Service, and ends when the content is deleted, subject to backups and to records we must keep by law.
6.3 You are responsible for Your Content: for its legality, its accuracy, and for not infringing anyone else's rights. You confirm that you have the rights needed to grant the licence in section 6.2.
6.4 Attribution on the Blog is limited to the public push name a sender uses in the Group. We do not verify identity and we do not publish contact details.
6.5 We may remove, restrict or unpublish content — and may suspend the Blog — if we reasonably believe it is illegal, infringes third-party rights, breaches these Terms, or exposes us or others to legal or security risk. Where it is lawful and practical to do so, we will tell you what we removed and why, and give you the chance to respond.
6.6 If you send us ideas or feedback, we may use them without restriction or payment. This does not give us any rights in Your Content beyond section 6.2.
7. Acceptable use
7.1 You may not use the Service to create, publish or distribute content that:
(a) is illegal under Israeli law or the law that applies to you or your readers;
(b) infringes copyright, trade marks, privacy, confidentiality or any other right;
(c) is defamatory, harassing, threatening, hateful, or an incitement to violence;
(d) reveals private information about a person without their consent, including addresses, identity documents, financial details or health information;
(e) sexualises minors, or endangers a child in any way;
(f) is spam, a scam, a phishing attempt, or misleading commercial content;
(g) contains malware or code designed to interfere with systems; or
(h) impersonates a person or organisation in a way that misleads.
7.2 You may not attempt to bypass Plan limits, probe or breach our security, interfere with other customers' Blogs, resell the Service without a written agreement, or systematically extract data from the Service to build a competing product.
7.3 We may suspend or terminate a Blog or account for a serious or repeated breach of this section, for non-payment under section 8.6, or where the law requires it. Where the breach can be cured and the risk is not urgent, we will give you notice and a reasonable opportunity to fix it.
8. Plans, prices and billing
8.1 The Service is offered on the following Plans. All prices are in Israeli new shekels (ILS) and include VAT.
| Plan | Blogs | Monthly | Annual |
|---|---|---|---|
| Basic | 1 | ₪89 | ₪890 |
| Advanced | 3 | ₪199 | ₪1,990 |
| Premium | 10 | ₪499 | ₪4,990 |
| Enterprise | by quotation | from ₪1,490 | annual invoice |
8.2 An annual Plan costs the same as ten monthly payments. The remaining two months are included at no charge.
8.3 Enterprise Plans are agreed by quotation. Their scope, number of Blogs, price and payment schedule are set out in the quotation or order form, which prevails over this section if it conflicts.
8.4 Billing is handled by Polar.sh as Merchant of Record. Polar processes the payment, issues the receipt or tax invoice, and handles applicable taxes. Its own terms and privacy policy also apply to the payment transaction. We do not receive or store your full card details.
8.5 Paid Plans renew automatically at the end of each Subscription Period, at the price then in effect, until you cancel. You can cancel at any time from your account or by writing to [email protected]. Cancellation stops the next renewal; the current Subscription Period is not shortened, and the Blog stays live until it ends.
8.6 If a payment fails or is not made, we will notify you and pause updates to your Blog. The Blog stays readable, and your data is kept for 60 days after cancellation as described in section 12.3. If payment is completed within that period, the Blog resumes.
8.7 We may change prices. We will give at least 30 days' notice before a change takes effect for you, and the change applies from your next renewal, not retroactively.
8.8 Refunds and the 30-day money-back guarantee are set out in the Refund and Cancellation Policy, which forms part of these Terms.
9. Pause, backfill and fair use
9.1 The pause control stops new posts from being published. Messages sent while a Blog is paused are not published unless you use backfill, and backfill depends on what the platform still makes available at the time you use it.
9.2 Backfill is limited to recent history that the platform exposes to the connected account. We do not guarantee that any particular message, media file or reaction can be recovered.
9.3 Usage is subject to the storage, media and volume limits published for your Plan. Where usage substantially exceeds normal patterns for your Plan and affects other customers, we may ask you to upgrade or reduce usage.
10. Privacy and data protection
10.1 Our Privacy Policy explains what we collect, why, how long we keep it, and the rights available to you and to Group members.
10.2 For the Content you publish, you act as the controller and we act as the processor, processing it on your instructions to operate the Service. For account, billing, support and service-security data, we act as the controller.
10.3 Where a data processing agreement is required, we will provide one on request at [email protected].
10.4 You must not use the Service to publish special categories of personal data (such as health, genetic, biometric or criminal-record data) unless you have a lawful basis for doing so and any additional safeguard the law requires.
11. Availability and support
11.1 We aim to keep the Service available continuously, but we do not guarantee uninterrupted availability. No service level is offered except under an Enterprise Plan, where any service level is stated in the quotation.
11.2 Availability may be affected by maintenance, third-party outages, and changes to WhatsApp or other platforms that we do not control. We will make reasonable efforts to give notice of planned maintenance.
11.3 Support is provided by email at [email protected] on Israeli business days. We do not guarantee a response time except where an Enterprise Plan says otherwise.
11.4 We do not guarantee search-engine ranking, traffic, audience growth, revenue, or any particular commercial result.
12. Suspension, cancellation and deletion
12.1 You may cancel at any time and may delete your Blog at any time from your account. You may request an export of your data at any time while your account is active and during the retention period in section 12.3.
12.2 We may suspend or terminate your access for a material breach of these Terms, for non-payment under section 8.6, for illegal content or abuse under section 7, where we are required to do so by law, or where continuing to provide the Service would expose us or others to serious risk.
12.3 After cancellation or termination, updates stop and the Blog is unpublished. Your data is kept for 60 days, during which you can request an export, and is then deleted from our production systems. Residual copies may remain in encrypted backups until those backups are overwritten in the ordinary course, and we retain records we are required to keep by law, such as invoices.
12.4 If you delete your Blog, it is removed from public view. Deletion of the Blog and deletion of your account data follow the same 60-day retention rule unless you ask us to delete sooner, subject to our legal record-keeping obligations.
12.5 Sections that by their nature should survive termination — including content licences for material already published, payment obligations, disclaimers, limitation of liability and governing law — survive.
13. Disclaimers
13.1 The Service is provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
13.2 We do not review Content before it is published and we do not verify its accuracy. Publication through the Service is not an endorsement of any message, sender or Group.
13.3 Automated formatting, titling and summarisation may produce errors. You are responsible for reviewing what is published on your Blog.
13.4 Nothing in this section excludes a warranty or right that cannot be excluded under the Consumer Protection Law or any other applicable law.
14. Limitation of liability
14.1 To the extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
14.2 To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of goodwill, loss of data, or business interruption.
14.3 Nothing in these Terms limits liability for wilful misconduct or gross negligence, for death or personal injury, for fraud, or for any liability that cannot be limited by law, including mandatory consumer rights under the Consumer Protection Law.
14.4 You are responsible for the content you publish and for any claim arising from it. If you are a business customer, you will indemnify us against third-party claims arising from Your Content or your breach of these Terms, to the extent permitted by law. This indemnity does not apply to consumers.
15. Changes to these Terms
15.1 We may update these Terms to reflect changes in the Service, in the law, or in our practices. The current version is always published with the Service, with its version number and date.
15.2 If a change materially affects your rights or obligations, we will give you reasonable notice before it takes effect and, where the change is significant and adverse, the right to cancel before it applies. Continued use after the effective date means you accept the updated Terms.
16. Governing law and jurisdiction
16.1 These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules.
16.2 The competent courts in Israel have jurisdiction over disputes arising from these Terms or the Service. Nothing in this section prevents a consumer from bringing a claim in the court that the law makes available to them, or from approaching a consumer protection authority.
16.3 Before starting proceedings, please contact us at [email protected] so we can try to resolve the issue directly.
